1. Introduction

Welcome to Ridle, a service provided by Collibet India ("we," "us," or "our"). By using the Ridle app, you ("user," "you," "your") agree to comply with and be bound by the following terms and conditions. These terms govern your access to and use of our services, so please read them carefully. If you do not agree with these terms, you may not use the Ridle app or services.

2. Services Provided

Ridle is a mobile application that connects drivers and customers for transportation services in Ahmedabad, India. Our platform facilitates the connection between drivers and customers, allowing them to arrange rides conveniently. Ridle itself does not provide transportation services; it acts as a facilitator to enable drivers and customers to find and transact with each other.

  • Scope of Services: Ridle provides a platform where:
    • Drivers can offer transportation services to customers.
    • Customers can find and engage drivers for transportation services.
  • Platform Access: Ridle grants users a limited, non-exclusive, non-transferable, revocable license to access and use the app for personal, non-commercial use, subject to these terms.

3. User Accounts

To use the Ridle app, users must create and maintain an account.

  • Eligibility:

    • Age Requirement: You must be at least 18 years old to create an account and use Ridle.
    • Legal Capacity: You must have the legal capacity to enter into a binding contract under Indian law.
  • Account Registration:

    • Information Required: Users must provide accurate, complete, and up-to-date information during the registration process, including name, contact information, and payment details (for drivers).
    • Verification: We may request additional information or documentation to verify your identity as part of our security and compliance measures.
  • Account Security:

    • Confidentiality: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
    • Unauthorized Access: Notify us immediately at [email protected] of any unauthorized use of your account or any other breach of security.
    • Account Management: You agree to maintain your account information and promptly update any changes to ensure it remains accurate and complete.
  • Account Termination:

    • Voluntary Termination: You may terminate your account at any time by following the instructions in the app or contacting us at [email protected].
    • Involuntary Termination: We reserve the right to suspend or terminate your account at our discretion if we determine that you have violated these terms or engaged in conduct that harms the Ridle community.

4. Driver Obligations

Drivers who use Ridle to offer transportation services must comply with the following obligations:

  • Daily Fee:

    • Amount: Drivers are required to pay a fee of 30 INR per day to access the Ridle platform. This fee is used to maintain and improve the app and its services.
    • Payment Terms: Fees must be paid in advance for each day the driver intends to use the service. Payment can be made through the app using the available payment methods.
    • Non-refundable: Driver payments are non-refundable, except as required by law or at our discretion in cases of service disruptions or errors.
  • Conduct and Compliance:

    • Legal Compliance: Drivers must comply with all applicable laws and regulations, including traffic laws, licensing requirements, and insurance requirements.
    • Professional Conduct: Drivers must provide a safe, courteous, and professional experience for customers at all times. This includes maintaining a clean and well-maintained vehicle and treating customers with respect.
    • Safety Standards: Drivers must adhere to safety standards and guidelines as outlined by local authorities and Ridle’s policies.
  • Vehicle Requirements:

    • Condition: Drivers are responsible for ensuring their vehicle is in good working condition and complies with all relevant safety and legal standards.
    • Documentation: Drivers must have all required documentation, including a valid driver's license, vehicle registration, and insurance. Ridle reserves the right to request proof of documentation at any time.

5. Customer Obligations

Customers who use Ridle to find and engage drivers for transportation services must adhere to the following obligations:

  • Payment:
    • Direct Payment: Customers must pay drivers directly at the end of each ride. The payment amount should be agreed upon before the ride commences.
    • Payment Disputes: Ridle does not facilitate or process payments between customers and drivers, and we are not responsible for any disputes that may arise regarding payments. Customers and drivers are encouraged to resolve payment disputes directly.
  • Conduct:
    • Respectful Behavior: Customers must behave respectfully towards drivers and comply with applicable laws during rides. This includes refraining from illegal activities, harassment, or any behavior that endangers the driver or other passengers.
    • Property Damage: Customers are responsible for any damage caused to the driver’s vehicle during the ride. In such cases, customers agree to compensate the driver for the cost of repairs or cleaning.

6. Payment and Fees

Ridle operates on a straightforward payment model:

  • Driver Payments:

    • Non-refundable: Payments made by drivers to use the Ridle service are non-refundable, except as required by law or at our discretion.
    • Payment Methods: Drivers can make payments through the app using available methods such as credit/debit cards, digital wallets, or bank transfers.
    • Failure to Pay: Failure to pay the daily fee may result in suspension or termination of the driver’s access to the Ridle platform.
  • Transaction Fees:

    • Customer Transactions: Ridle does not charge customers any fees for using the app.
    • Driver Transactions: Drivers are responsible for any transaction fees that may be incurred when making payments to use the platform. These fees are typically charged by payment processors or banks.

7. Limitation of Liability

Ridle provides the platform "as is" and "as available," and we do not guarantee the availability, reliability, or security of our services.

  • Disclaimer of Warranties: To the maximum extent permitted by law, we disclaim all warranties, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • Limitation of Liability: We are not liable for any direct, indirect, incidental, or consequential damages arising from the use of the app or services, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses.
  • No Liability for User Conduct: Ridle is not responsible for the actions or conduct of users (drivers or customers). We do not guarantee the quality, safety, or legality of services provided by drivers or the behavior of customers.

8. Indemnification

You agree to indemnify, defend, and hold harmless Ridle, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of the app or services, your violation of these terms, or your violation of any rights of another.

9. Termination

  • Suspension or Termination: We reserve the right to suspend or terminate your access to Ridle at our discretion if you violate these terms or engage in conduct that harms the Ridle community.
  • Effect of Termination: Upon termination, your right to use the app and services will cease immediately, and any fees paid are non-refundable.
  • Survival: The provisions of these terms that by their nature should survive termination will survive, including but not limited to indemnification, limitation of liability, and governing law.

10. Changes to Terms

We may update these terms from time to time to reflect changes in our services, policies, or legal requirements.

  • Notification: We will notify users of significant changes through the app or via email. It is your responsibility to review these terms periodically for any updates.
  • Acceptance of Changes: Continued use of Ridle after any changes constitutes acceptance of the new terms.

11. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of India.

  • Jurisdiction: Any disputes arising out of or relating to these terms will be subject to the exclusive jurisdiction of the courts in Ahmedabad, India.

12. Dispute Resolution

  • Informal Resolution: Before filing a formal dispute, users agree to attempt to resolve any issues informally by contacting us at [email protected].
  • Arbitration: If informal resolution is unsuccessful, disputes may be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996. The arbitration will be conducted in Ahmedabad, India, and the language will be English.
